TERMS & CONDITIONS. Your contract is with InsideJapan Tours Ltd
1. Introduction
InsideJapan Tours Ltd. specialises in flexible tours of Japan for clients wishing to see more than just the regular tourist attractions. This type of holiday carries a small risk that alterations beyond our control may take place at short notice. We will however endeavour to ensure that the arrangements for your holiday are to your satisfaction. You will be informed about any changes to any of the relevant details within the web site when you book with us. Our accompanied tour prices include accommodation, breakfast every day and transport between destinations as well as some extra meals as detailed. Local transport (city bus, metro, taxis) is not included in the cost of the package and local transport to Mt. Fuji is also at your expense. Tailored packages include all elements as detailed on your payment invoice which you will receive from us upon confirmation of your booking.
2. Booking and Payment
You must complete a booking form and send it to us by post, e-mail or fax or book directly with us by telephone or e-mail. On receipt of your booking we will confirm your booking details by either e-mail or post and will send you an invoice by e-mail or post. All payments should be made by cheque or bank transfer. In the case of bookings placed more than 60 days prior to the start date of your package, an initial deposit of at least £100 per person is required. The final balance must be paid no less than 60 days before the start date of your package. In the case of bookings made less than 60 days before the start date of your package, we require payment in full upon receipt of your invoice. Please note that a contract is made when we accept your booking and your confirmation is posted or sent by e-mail. If we cannot accept your booking, any money paid will be refunded in full. Once we accept your booking the deposit is non-refundable. If you do not pay the full amount within the time specified, we reserve the right to treat your failure as cancellation, and you will forfeit the deposit paid and be liable to cancellation charges. The person who signs the booking form accepts responsibility for the payment for all persons listed on the booking and is responsible for keeping all party members informed of booking details.
3. Cancellation by you
You or any member of your party may cancel your confirmed booking, but this must be in writing. If you cancel after receiving written confirmation and invoice, or if you fail to pay the full cost of the holiday within the specified time, you will be liable to pay cancellation charges. Cancellation charges are as follows: If you cancel more than 60 days before the start of your holiday with us you forfeit the deposit paid. If you cancel within 60 days you forfeit 50% of the cost of your holiday. If you fail to take up your holiday you forfeit 100% of the cost of your holiday. The effective date of notification of cancellation will be when said notification is received at our premises.
4. If we alter your Holiday
We reserve the right to make minor changes to the web site details and holiday arrangements both before and after you have booked your holiday. In such cases we will endeavour to contact you. If we make significant changes to your holiday arrangements we will inform you at the earliest opportunity. A significant change is a change to the dates of the holiday or a change of itinerary or accommodation type. In such cases you will have the choice of either accepting the change or booking an alternative holiday (and paying or receiving a refund in respect of any price difference), or cancelling your holiday and receiving a full refund of all payments made. However, some activities and destinations are dependent on prevailing weather conditions and changes may have to be made to your holiday after you have started it. If, in our judgement, the weather is unsuitable for a specific activity or destination we reserve the right to cancel or alter that activity or destination. If we have to cancel an activity or destination we will endeavour to replace it with an alternative of equal interest.
5. Minimum Numbers
Our accompanied tours are based on a minimum number of three participants. In the unlikely event that these numbers are not reached we reserve the right to cancel the tour and refund all payments made. In these circumstances we will offer an unaccompanied tour of a similar itinerary to the booked accompanied tour at a 20% discount. Your are under no obligation to accept this offer. The ?Tokyo Nights? package and tailored packages have no minimum number of participants.
6. Changes by you
If you wish to alter your booking in any way after the confirmation and final invoices have been issued, we will endeavour to make the necessary arrangements.
7. Holiday Prices
When you have booked your holiday and paid your deposit or the total holiday price, the total holiday price as shown on your confirmation invoice is fully guaranteed and will not be subject to any surcharges.
8. Our Liability To You
InsideJapan Tours Ltd. accepts liability for the proper performance of the holiday sold to you. We accept responsibility for the actions of our employees, provided they were acting within the scope of, or in the course of their contract of employment, except where death, personal injury or illness results. We will pay you reasonable compensation for failures on our part or for failures on the part of our suppliers. If you or any member of your party suffers death, illness or injury as a result of any failure to perform, or improper performance of, any part of this contract with you, InsideJapan Tours Ltd. accepts responsibility, providing that the employee responsible was acting within the course of his contract of employment, unless the failure to perform or improper performance was attributable to:
your own acts and/or omissions; or
b) those of a third party not connected with the provision of your holiday and which were unforeseeable or unavoidable;
c) an event which neither InsideJapan Tours Ltd. nor the supplier of the service(s) in question could have foreseen or prevented even with all due care.
d) InsideJapan Tours Ltd. will not be in breach of this agreement or otherwise liable to the Client for any delay in performance or any non-performance of any obligations under this agreement if the delay or non-performance is owing to a circumstance beyond the reasonable control of InsideJapan Tours Ltd., including but not limited to acts of God.
All claims must be notified immediately to us and confirmed in writing within 30 days.
9. Baggage
We cannot be responsible for loss of or damage to baggage, personal effects, money or documents.
10. Complaints
InsideJapan Tours Ltd. aims to provide you with the best holiday possible but if a problem should arise, you must report it immediately or as soon as reasonably possible to our local representative and subsequently in writing to us within 30 days of return. We will not accept liability for any complaint not reported to our representative, if such a complaint could have been resolved had it been reported.
11. Passports, Visas and Health
It is your responsibility to ensure that all members of your party are in possession of a passport and visa valid for all countries to be visited and that, where applicable, all inoculations have been carried out and health certificates are available. Please consult your doctor well in advance of departure. We will offer such assistance and advice in obtaining visas and permission as we can but we cannot in any circumstances be responsible if you or members of your party are not granted a visa or permitted entry into any country. If such refusal occurs and you cancel your holiday this will be treated as described in clause 3.
12. Mt. Fuji climb and Special Events
It is not possible to guarantee seeing special events such as festivals and fireworks displays. The climb of Mt. Fuji available in some of our packages, is optional, undertaken at your own risk and dependent on weather conditions. The official climbing season runs from July 1st to August 1st only.
13. Travel Insurance & IPP insurance
We strongly recommend that you take out adequate travel insurance for the duration of your trip. International Passenger Protection (IPP) will cover you against costs incurred (up to the cost of your holiday and subject to certain conditions) in the unlikely event of our failure or financial insolvency.
14. Your Contract with InsideJapan Tours Ltd.
These Terms and Conditions constitute the whole and only agreement in relation to your holiday.
15. The Law
Your contract is with InsideJapan Tours Ltd. and any matters arising from it shall be governed by and construed in accordance with English law and is subject to the jurisdiction of the Courts of England and Wales.
